Will overseas R&D ban hit tax relief claims?

The Chancellor's announcement that expenditure on R&D outside the UK would no longer be eligible for UK R&D tax relief will have been a blow for many companies. But Sandy Findlay, partnership director at ABGi-UK, believes the door has not completely closed, and that there are exceptional conditions under which claimants will still be able to claim relief. These include instances where factors such as geography, environment, population or other conditions not present in the UK, but indispensable to research, mean a project can only be carried out overseas. Similarly, he says, regulatory or legal conditions may mean projects need to take place outside the UK. He also points out that materials sourced overseas, as well as costs related to data and cloud computing sourced overseas, can still be claimed if these are an intrinsic part of R&D carried out in the UK.
